Notwithstanding the provisions of the preceding paragraph, the internal control procedure of the obligated entity may provide that the decision be previously submitted to the consideration of the internal control body. In principle, it is not necessary to keep all documents strictly in physical format. The General Tax Law does establish the obligation to keep all the supporting documents related to our tax obligations. That is to say, we must keep everything that we have contemplated in the company’s accounting, as well as in the tax returns.
Thus, we must keep the invoices, receipts, payments, collections and documents issued to third parties, as well as all the documentation received when making any expense, investment or purchase. However, it is not necessary to keep or deliver them on paper.
In fact, Royal Decree 1619/2012 establishes that “this obligation may be fulfilled through the use of electronic means”, provided that the authenticity, origin, integrity and legibility of the invoices are not compromised, and it is ensured that the Administration can access them without delay.
In this sense, we can keep our tax and accounting documentation electronically. As stated in Order EHA/962/2007: “Taxpayers may proceed to the certified digitalization of invoices, substitute documents and any other documents that they keep on paper that have the character of originals”.
