When we talk about a Double Taxation Agreement, we refer to an International Treaty signed between two States, through which the rules are established by which the income is subject to the tax system of the first signatory country, when the income is obtained in the same country by the citizens of the second country or vice versa. The objective of the Double Taxation Agreements (DTA) is to find a solution to the following problems:1.- Avoidance of international double taxation, which is defined as “the situation whereby the same income or the same asset is subject to taxation in two or more countries, for all or part of its amount, during the same tax period – in the case of periodic taxes – and for the same reason”. 2.- Problem of tax sovereignty, due to the distribution of powers to the signatory States to obtain the payment of taxes on the income obtained by the citizens.however, when we speak of double taxation, we refer to the emergence of two or more tax obligations for the same taxable event and tax period.it is here where we must establish a delimiting framework between the two types of double taxation, legal and economic:

International trade has for centuries been a driver of economic development. As rich countries take the lion’s share in this intensely political process, some goods that poor countries produce very efficiently, for example agricultural goods, still face high tariffs in rich countries. The trade component of the IDC penalizes countries that impose trade barriers on imports of food, clothing and other goods from poor nations. It takes into account two kinds of barriers: tariffs and subsidies to domestic farmers, which encourage overproduction and depress world prices.
The CDI mandates the 27 richest and most developed countries in the world, which constitute the majority of the DAC (the official aid donor organization) of the OECD, along with one DAC observer (Hungary).

What is a child development center (CDC)?
International double taxation, in a legal dimension, means that an income of the same person is simultaneously taxed in two different countries, generating an excessive burden. Thus, if the branch of a local company suffers an income tax of 30% in its host country and in Colombia pays 40% on the same income, without any tax relief, there would be a combined taxation of 70% that would make the investment unsustainable. This phenomenon is mitigated by domestic legislation measures, such as the discount of the foreign tax in Colombia, while other countries exempt the offshore income of their companies.
However, these remedies cover only part of the problem, and therefore the agreements arise to define, in a bilateral context, the types of income on which each country may or may not tax ─or share taxation─ when it receives an investment or activity from a resident of the other country.
It is intended to rationalize the burden for the non-resident through certain limits on the tax on its profits and the reduction of withholding tax rates on different incomes (dividends, royalties, interest, consultancies, etc.), encouraging the increase of investment in a reciprocal manner. By lowering the tax cost for inbound investment, the aim is to increase growth in the domestic market, and by reducing the tax cost in the country of destination of the outbound investment, economic growth is boosted through expanding multinationals. The aim is to increase revenue through the fiscal dividend for greater economic growth.
