Too often, the effective advancement of human rights can be undermined by the practice of gatekeeping: a process by which a few individuals decide the amount of information, participants and locations to which a researcher or civil society actor can gain access. In return, these gatekeepers gain financial gain and become the first contacts for any newcomers. Unfortunately, civil society organizations and researchers rely heavily on these gatekeepers in their work with communities, and often fail to generate adequate community mobilization and participation. Consequently, gatekeeping becomes an impediment to the voices of the most marginalized, and NGOs must create innovative methods to overcome this.

Strengthening the capacity of social movements in terms of human rights advocacy and community budgeting is therefore essential to ensure that community groups have meaningful participation in resource allocation and decision-making. Community mobilization, however, does not involve identifying just a few individual representatives. It requires the use of organized community structures, including local authorities, social movements, women’s groups and youth groups. It is essential to diversify community entry strategies to ensure a comprehensive exercise of human rights through greater involvement of individuals, with structured participation and feedback mechanisms, and by encouraging meaningful contributions to the decision-making process.

4. Any rule of law, including customary law, inconsistent with this Constitution is void to the extent of such inconsistency, and any act or omission contrary to this Constitution is invalid.
