At what distance from the railway track can it be built?
Having regard to Directive 2008/57/EC of the European Parliament and of the Council of 17 June 2008 on the interoperability of the rail system within the Community (1 ), and in particular the second subparagraph of Article 6(1) thereof,
Article 12 of Regulation (EC) No 881/2004 of the European Parliament and of the Council (2 ) establishing a European Railway Agency requires the European Railway Agency (hereinafter referred to as ‘the Agency’) to ensure that the technical specifications for interoperability (hereinafter referred to as ‘TSIs’) are adapted to technical progress, market developments and social requirements and to propose to the Commission such amendments to the TSIs as it considers necessary.
By Decision C(2010) 2576 of 29 April 2010, the Commission gave the Agency a mandate to draw up and revise the TSIs in order to extend their scope to the entire rail system of the Union. Under this mandate, the Agency was asked to extend the scope of the TSIs concerning the rolling stock subsystem ‘locomotives and passenger rolling stock’ to the whole Union rail system.

That through Resolutions 181760 of 2004 and 180372 of 2005 the date of entry into force of the RETIE was extended, the first one until March 31, 2005 and the second one until April 30, 2005, which was due, among other aspects, to the need to make some adjustments to the Technical Regulation before its entry into force, in order to guarantee its effective applicability;
That as a result of the analysis and dynamics of the Technical Regulation, it is necessary to specify some technical aspects in order to ensure its effective application; likewise, it is necessary to make adjustments to the wording and presentation of the annex, so that the established requirements can be easily identified;
ARTICLE 1. To modify the Technical Regulations for Electrical Installations contained in the general annex of Resolution 180398 of April 7, 2004, which has been modified and clarified by Resolutions 180498 of April 27, 2005, 181419 of November 1, 2005, 180466 of April 2, 2007 and 182011 of December 4, 2007.
