When is the energy efficiency certificate mandatory?

When is a property exempt from the energy certificate?
The legislation exempts those buildings or parts of buildings that are used for less than four months a year or for a limited time and consume less than 25% of the energy they would expend if used for the full twelve months.

Since last June 3, 2021, a new regulation came into force, which repeals the previous Royal Decree 235/2013, approving the basic procedure for the certification of the energy efficiency of buildings.
All these changes that have been introduced in this new regulation give much more importance to the energy certificate to improve the quality of information and understanding by citizens, in addition to adapting to the regulations and the objectives set in the National Integrated Energy and Climate Plan 2021-2030 to achieve the challenge of decarbonization of the decarbonized park to 2050.
What happens if I don’t have the energy efficiency certificate?
If you have a home and you have not yet taken the energy certificate seriously, it is time to do so because, not doing so, can result in fines of up to 6,000 euros, according to Law 8/2013 of rehabilitation, regeneration and urban renewal.
Who has to pay for the energy performance certificate?
The energy efficiency certificate will be valid for ten years and its cost will be borne by the owner of the property, whether seller or tenant. It will also be their responsibility to renew it.

In residential properties it is essential to have domestic hot water to calculate the energy certificate. A house without hot water is not considered habitable, so it could not be sold or rented. But there are commercial premises that do not need hot water because of their use, so the energy certification of a business can be carried out without hot water installed.
How much does the energy efficiency certificate cost?
It is estimated that, on average, the price of the energy efficiency certificate has a cost of 1.50 €/m2. Therefore, in a 50-100 m2 house, the cost of the energy certificate can be around 60-130 €.
How long does it take to obtain an energy efficiency certificate?

After the visit, the technician takes a maximum of 48 hours to prepare the energy certificate and submit it to the registry authorized by the autonomous community.
How do I know if I have an energy certificate?
Access can be made through three ways: Through the certificate search engine you can download the energy efficiency label of any building registered in the registry. It allows you to search for address, procedure code or cadastral reference.

These three applications determine the Energy Rating of Buildings by means of the objective data that the technician in charge has previously obtained from the building and by means of other data that the software estimates automatically.
This is how the abbreviated procedures work. Once the data entry process is completed, the software provides the energy label whose ratings range from A, B, C, D, E, F and G, with A being the most efficient rating and G the least efficient.
