To have a valid complaint, you must allege that your employer took at least one “adverse action” against you. An action is “adverse” if it affects your conditions of employment in any negative way (see examples below).
Because you complained about failure to pay minimum wage, overtime pay, wage recordkeeping, child labor, Family and Medical Leave Act requirements, etc.
Because you complained about the lack of protections for migrant or seasonal workers, polygraph testing, or protections for workers in certain seasonal worker programs
Because you participated in joint protected activities (group action to improve wages, benefits, and working conditions), union activities, with the support of a union, or chose not to participate in union activities
When there is a labor infraction, not all breaches of the law must be reported to the Labor Inspectorate. In some cases, it is necessary to go to the Labor Courts. Let’s see what types of cases correspond to each one:
Some situations can be reported to both (Social Courts and Labor Inspection), depending on the evidence you have. If you have evidence, you can go to the Court, if you do not have enough evidence, you can report it to the Labor Inspectorate for investigation.
